Terms & Conditions

1. Inspection of Horse

Availability for Inspection: All horses listed for Auction by Aljassimya Farm ("AJF" or "Seller") are available for public inspection prior to the Auction event. Such inspections are permitted only at the following locations:

  1. 100 Oaks Ranch, California, U.S.A
  2. Giacomo Capacci Arabians, Italy

Appointment Requirement: Inspection of any Auction lot must be arranged by prior appointment. Participants wishing to inspect the horses must contact AJF to schedule an inspection time. AJF reserves the right to limit inspection times and conditions based on availability.

2. Registration

To participate in AJF online Auction (“Auction”) and be entitled to place bids, a registration form must be filled online and submitted with all details and information requested.

The online registration will activate an official account on AJF Auction website, which will enable the user to bid online for the entire duration of the Auction. After filling up and submitting the registration form, a deposit of Two Thousand Five Hundred United States Dollars ($2,500.00 USD) (“Deposit”) must be made, upon such payment the account will be activated and enable the user to access the bidding system.

  1. In the event of a successful buy, the buyer must pay the horse in full according to point (4) and (9) below in these Terms and Conditions. Once the payment is acknowledged to be received by the Seller, the buyer’s Deposit shall be reimbursed in full.
  2. In the event no purchase has been made during the Auction, the Deposit will be unlocked and transferred back to the credit card.
  3. In case of a successful bid followed by a missing payment from the buyer, the Deposit is to be retained by the Seller, AJF, and will not be reimbursed in any case whatsoever.

If the buyer is in contact with an Official AJF broker, the broker code has to be added in the registration form during the account creation and user registration.

3. Bidding Procedure

Prospective buyers may register prior to or during the Auction. The Auction will run for seven (7) days, with open bidding available globally. All prices are listed in United States Dollars and exclude VAT. The highest bidder will be deemed the buyer and must sign the attached “Acknowledgement of Purchase,” which serves as a binding agreement and supersede the Terms and Conditions herein. If the successful bidder fails to sign, the horse will be relisted for sale. AJF reserves the exclusive right to withdraw any lot from the Auction at its sole discretion, at any time prior to the horse being sold

4. Financing

Subject to Clause 2.a above, the successful bidder (“Buyer”) must pay the full purchase price of the horse in accordance with the terms outlined in Clause 9 below along with the provisions of the Acknowledgement of Purchase. Any bidder who fails to make payment, as required, will be deemed in default and will forfeit the Deposit, with the lot reverting to the Seller’s sole ownership. Upon successful payment, the horse must leave its location wether at Aljassimya Farm in California, U.S.A. Aljassimya Farm, Qatar; or Giacomo Capacci Arabians, Italy, within fourteen (14) days from the date the Seller receives full payment. The Buyer is solely responsible for all transportation costs from the aforementioned locations to any other destination. If the Buyer experiences a delay in transportation, the Buyer must provide an official written notice via email to the AJF team, outlining the reason for the delay and specifying a revised timeline. A fee of $500 USD per month will be charged to the Buyer for any delay.

5. Sales Tax

The Buyer agrees and acknowledges that the final purchase price, as determined by the highest recognized bid, is non-negotiable. The bid amount is the net price and does not include VAT.

6. Cancellation of Sale

If the Buyer does not sign the Acknowledgement of Purchase within 30 minutes of receiving it (or, in the case of online bidding, revoke the confirmation of sale by email), the horse may be re-auctioned or offered to the second-highest bidder. In such cases, the original Buyer will be fully liable for any loss of proceeds, and a cancellation fee of 5% will be deducted from the deposit made. Once the Acknowledgement of Purchase is signed, no cancellations will be allowed.

7. Condition of Sale

Upon acceptance of the bid, all risks are transferred to the Buyer, and no objections will be accepted thereafter. The horses are sold as-is, based on the condition in which they are presented on the Auction website. The Seller cannot be held liable under any circumstances. Ownership transfer will occur only after the Seller acknowledges receipt of full payment for the purchase price. The Buyer is not entitled to retain any part of the purchase price for any reason. The Buyer is fully responsible for all transportation, registration, transfer of ownership, and passport costs. Should the Buyer wish to have a veterinary check conducted on the horse, the cost will be borne entirely by the Buyer, and the Buyer must arrange this during the inspection period. Please review the Acknowledgment of Purchase Agreement in full prior to participating in the Auction.

8. Buyer Expenses

The Buyer shall be responsible for all costs associated with the stabling and care of the horse between the auctions conclusion (knockdown) and its transportation. The Buyer will be charged for boarding and any other expenses incurred, in accordance with the terms of this Agreement.

9. Terms of Payment

Payment must be made via bank transfer in a single transaction. The payment is to be NET, with no additional bank wire fees to be covered. The payment should be made to the following account:

A copy of the payment confirmation must be sent to the AJF team on the same day of payment for transaction acceptance.

10. Sellers Right

The Seller reserves the right to alter the course of the Auction program, including the right to offer horses together, separately, or to withdraw them from the Auction entirely.

11. Horse Insurance

Horses are not insured after the knockdown. Life insurance may be arranged at the Buyer’s full expense. After the purchase, AJF assumes no responsibility for the horse. Full responsibility and liability for the horse, including any insurance costs, are automatically transferred to the Buyer at their sole expense whatsoever. AJF online auction is partnering with Jarvis Insurance for the project, which offers packages to ensure the horses. After the purchase, AJF is not responsible for anything that could happen to the horse, the full responsibility and liability of the purchased horse is automatically transferred to the Buyer at its own sole expenses, as well as the costs for the Insurance on the horse, if applied.

12. Terms & Conditions

The terms and conditions of the Auction, along with any claims arising from them, shall be governed by and construed in accordance with the laws of Qatar. Any disputes or actions arising from or related to these terms will also be subject to Qatari law. By registering on the Auction site, the user automatically agrees to and is bound by these Terms and Conditions. All bidders must adhere to the rules set forth by AJF. In the event of unlawful behavior, AJF reserves the right to take legal action against the buyer. For further information, please contact the AJF team.
